Terms of Service

These Terms of Service describe the rules and conditions for using SellMize AI. They are written to be clear and practical for an early-stage SaaS product while protecting both you and the platform.

1. Acceptance of Terms

By accessing or using SellMize AI, you agree to these Terms of Service. If you do not agree to these Terms, do not access or use the service.

2. Description of the Service

SellMize AI is an analytics and AI-powered platform for Amazon India sellers. The service includes profit analytics, inventory intelligence, AI chat and research tools, and forecasting features designed to help sellers understand and manage their business data.

3. User Accounts

  • You must provide accurate and complete information when creating and maintaining your account.
  • You are responsible for keeping your login credentials confidential and for all activity that occurs under your account.
  • You must notify us promptly if you believe your account has been accessed without authorization.
  • You may not share your account in a way that bypasses your subscription limits or intended use of the service.

4. Subscriptions and Payments

SellMize AI offers Basic and Pro plans. If you subscribe to a paid plan, the following terms apply:

  • You agree to pay the fees for the plan you select.
  • Paid subscriptions are billed on a recurring basis through Razorpay.
  • You may request cancellation at any time. When you cancel a subscription, the cancellation request is sent to the payment gateway and takes effect at the end of the current billing cycle.
  • After cancellation is requested, your in-app experience may immediately move to Basic plan limits, while the billing cancellation remains effective from the end of the current billing cycle handled by Razorpay.
  • We may change pricing from time to time. If we do, we will provide notice before updated pricing takes effect.
  • Except where required by law, subscription fees are generally non-refundable.

5. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. You retain ownership of the business data you upload to the platform. You are responsible for ensuring that you have the rights to upload and process any data you provide to the service. You grant SellMize AI a limited license to host, use, process, and transmit that data only as needed to operate the service, generate analytics, provide enabled features, support subscriptions, and maintain the platform as described in the Privacy Policy.

6. Third-Party Services

SellMize AI relies on third-party providers to operate certain parts of the service, including hosting infrastructure, analytics tools, AI and search providers, messaging integrations, and payment processors. By using the service, you authorize us to share the minimum necessary data with those providers to operate the features you use.

7. Acceptable Use

You agree not to:

  • Use the service for any illegal, fraudulent, or unauthorized purpose.
  • Attempt to interfere with, probe, or bypass the security or integrity of the platform.
  • Upload malicious files, harmful code, or data intended to disrupt the service.
  • Resell, redistribute, sublicense, or commercially exploit access to the service without our permission.
  • Use automated scraping, bots, or bulk extraction beyond normal intended use of the product.

8. Intellectual Property

SellMize AI and its related software, interface, algorithms, workflows, content structure, and branding are owned by us or our licensors and are protected by applicable intellectual property laws. These Terms do not give you ownership of the platform or any rights to use our branding except as needed to use the service.

9. AI-Generated Insights Disclaimer

Analytics, forecasts, recommendations, search results, and AI-generated outputs provided by SellMize AI are informational tools only. They are not financial, legal, tax, investment, or other professional advice, and you are responsible for reviewing outputs and making your own business decisions.

10. Service Availability

We work to keep SellMize AI available, but the service may occasionally be unavailable, interrupted, or limited due to maintenance, updates, third-party service issues, infrastructure problems, or other factors outside our control.

11. Force Majeure

We are not responsible for delays or failures in performance caused by events beyond our reasonable control, including infrastructure outages, internet disruptions, natural disasters, acts of government, or failures of third-party services.

12. Suspension and Termination

We may suspend or terminate access to the service if you violate these Terms, misuse the platform, fail to pay applicable fees, create security or legal risk, or if we are required to do so by law. You may also stop using the service or request account deletion from account settings, subject to any applicable retention or payment obligations.

13. Limitation of Liability

SellMize AI is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that analytics results, forecasts, or AI outputs will be accurate, complete, or suitable for every business decision. To the maximum extent permitted by law, our total liability for any claim related to the service will not exceed the amount you paid us for the service during the 12 months before the event giving rise to the claim.

14. Governing Law

These Terms are governed by the laws of India, without regard to conflict of law principles.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes to the service, pricing, legal requirements, or business operations. When we do, we will update the "Last updated" date on this page. Your continued use of SellMize AI after updated Terms take effect means you accept the revised Terms.

16. Entire Agreement

These Terms constitute the entire agreement between you and SellMize AI regarding your use of the service and supersede any prior or contemporaneous understandings on that subject.
